These Terms & Conditions exist to build a clear and honest foundation for the work we do together. They reflect the same values that guide every session and partnership: transparency, mutual respect, and a genuine commitment to your wellbeing.

1. About These Terms

These Terms & Conditions govern your engagement with The Genuine Wave Co. (hereinafter 'TGW', 'we', 'us', “Marta”) -  a coaching and breathwork practice founded and operated by Marta Soto, based in Barcelona, Spain.

By booking any session, program, or experience with TGW - whether via direct communication, our website at genuinewave.com, or any other channel - you confirm that you have read, understood, and agreed to these Terms in their entirety.

These Terms apply to all services offered by TGW, including integrative coaching sessions, breathwork experiences, and any events, workshops, or community experiences facilitated by TGW. 

We reserve the right to update these Terms at any time. Any changes will be communicated with reasonable notice. Continued engagement with TGW following such notice constitutes acceptance of the revised Terms.

2. About Our Work - Scope & Important Distinctions

2.1 What We Offer

TGW offers integrative coaching, breathwork facilitation, and other experiences designed to support your personal development, emotional wellbeing, and overall sense of alignment and purpose.

2.2 Coaching & Breathwork Are Not Therapy

Marta is not a licensed therapist, psychologist, or physician.

Breathwork is a somatic, experiential practice that works with conscious, connected breathing to support emotional release, nervous system regulation, and self-connection. While it can be profoundly transformative, it is not a medical intervention.

Coaching is a non-clinical practice. It is not psychotherapy, counselling, or any form of licensed mental health treatment. Coaching supports self-awareness, goal clarity, emotional regulation, and conscious decision-making. It is not a substitute for professional mental health care.

The information shared across our services is not intended to be a substitute for professional medical advice, diagnosis, or treatment which can be provided by your physician, therapist, or any other health care practitioner. 

If you are currently experiencing any symptoms of mental illness, have been recently diagnosed with a psychiatric condition, or are under medical supervision for a condition that may be relevant, we ask that you consult your healthcare provider before working with TGW. 

Your safety always comes first.

3. Health & Safety

3.1 Your Responsibility to Disclose

Before your first session - and whenever your health circumstances change - you agree to honestly disclose any physical or mental health conditions, medications, or relevant personal circumstances that may affect your participation.

3.2 Informed Consent

By booking a breathwork or coaching session, you confirm that you have signed the consent agreement handed to you prior to participating in any session.

4. Booking & Payment

4.1 Booking Confirmation

A session or programme is confirmed only once payment has been issued and you have received written confirmation from TGW (via email or WhatsApp).

Holding or reserving a time slot without payment does not constitute a confirmed booking. TGW cannot guarantee availability in the absence of confirmed payment.

4.2 Payment Methods

TGW currently accepts payment via:

  • Bank transfer (IBAN details provided upon booking)

  • Bizum (for clients based in Spain)

  • Stripe (card payment via our website)

Payment instructions will be communicated at the time of booking. If you experience any difficulty with payment, please contact us.

4.3 Changes & Cancellations

All paid registrations in all TGW offerings are non-refundable. If you do not attend a session or event in which you are enrolled a refund or credit is not available and you will need to purchase again if you wish to attend a future similar event. 

If you wish to cancel or reschedule a session, a 24h hours notice prior to the session must be given: 

  • More than 24h hours notice: full credit applied or session rescheduled at no charge

  • Less than 24h hours notice: the session will be charged in full

We are understanding of the fact that life happens, so exceptions to this policy are given under extenuating circumstances and at our discretion. Cases are handled with compassion and on a case-by-case basis. These policies are designed to honour both your time and ours, and to allow the work we do together to unfold with the care and consistency it deserves.

In the unlikely event that Marta needs to cancel a session, she will give you as much notice as possible and offer you the choice of a full reschedule or a refund of any payment made for that specific session.

TGW will not be held liable for cancellations due to circumstances beyond our control, including but not limited to illness, natural events, or technical failures. In such events, we will seek to reschedule where possible.

6. Confidentiality

6.1 Our Commitment to You

Everything shared within a TGW session - whether in a coaching context or a breathwork experience - is held in strict confidence.

To operate our services, TGW uses trusted third-party platforms. Each platform has GDPR-compliant data processing agreements in place. Your data is never sold or shared beyond what's necessary to deliver our service. You can request deletion from any platform at any time.

6.2 Limits of Confidentiality

There are narrow, important exceptions to confidentiality - situations where TGW may be legally or ethically obliged to act, regardless of the confidential nature of our relationship. These include:

  • Where there is an immediate and serious risk of harm to yourself or to others

  • Where disclosure is required by applicable law

In all other cases, your privacy is upheld absolutely. Should any of the above exceptional circumstances arise, TGW will, wherever safe and possible, speak with you directly before taking any action.

6.3 Group & Community Experiences

In group settings - workshops, events, or group breathwork - all participants are asked to honour a collective agreement of confidentiality. By participating, you agree not to violate the privacy or intellectual rights of any participant when attending any form of group session.

While TGW will always hold this standard and ask others to do the same, we cannot be held responsible for the conduct of other participants in a group setting.

7. Intellectual Property

All materials, exercises, generated resources, audio content, and documents created and shared by TGW - whether in sessions, via email, or through our website - remain the intellectual property of The Genuine Wave.

You are welcome to use these materials for your own personal development. You may not reproduce, distribute, sell, or share them publicly - in part or in whole - without prior written consent from TGW.

8. Data Protection & Privacy

TGW takes the protection of your personal data seriously, in full compliance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection law.

8.1 Who Is Responsible for Your Data

The Genuine Wave is operated by Marta Soto, based in Barcelona, Spain. She is the data controller responsible for your personal information collected through this website (www.genuinewave.com) and through the services provided.

8.2 What We Collect & How We Use it

We only collect information that is necessary to provide you with a safe, personalised, and effective service. Below is a clear breakdown of what is collected, and on what legal basis.

a) Contact and inquiry information

When you reach out through our website or online available forms, we collect your name and email address. This is necessary to respond to your enquiry and, where applicable, to fulfil our service agreement (lawful basis: contractual necessity and legitimate interest).

b) Health and somatic intake information

Through our intake form, we may collect information about your physical health, mental health history, emotional wellbeing, and relevant personal circumstances. This information helps Marta hold sessions safely and with appropriate care.

We will only process it with your explicit written consent. You may withdraw this consent at any time, though doing so may affect our ability to continue providing services to you safely. 

c) Payment information

If you purchase any service online through Stripe, payment is processed securely through their service. We do not store your card details directly - these are handled entirely by Stripe under their own privacy and security infrastructure. 

d) Newsletter and communications

If you sign up to receive updates, resources, or offers from Genuine Wave, we will use your email address for this purpose. This is based on your consent, and you can unsubscribe at any time using the link in any email we send.

e) In-session recordings

With your explicit prior consent, sessions may be recorded using transcription tools (currently Otter.ai or Fireflies.ai) for the purpose of session notes, integration support, and coaching review. Recordings will not be shared with any third party and will be deleted upon your request.

f) Images and written testimonials

With your explicit written consent, we may use photographs taken during sessions or events, and/or written reviews or testimonials, for marketing and promotional purposes (e.g. on our website or social media). You may withdraw this consent at any time, and we will remove the content from active use as promptly as possible.

8.3 Storage & Security

Your data is stored securely and accessed only by TGW. It is never sold, shared with third parties for marketing purposes, or used for any purpose beyond the delivery of our services.

Data is kept only as long as needed. You can request its deletion at any time. 

8.4 Third-Party Tools That Process Your Data

To operate our services, we use the following trusted third-party platforms. Each is bound by their own privacy policies and GDPR-compliant data processing terms. We will never sell your data to any third party, nor share it for commercial purposes.

8.5 Cookies

Our website is hosted on Squarespace, which may use cookies to support basic site functionality and analytics. You can manage or disable cookies through your browser settings at any time. A cookie notice will appear on your first visit to the site.

8.6 Changes to This Policy

If we make material changes to this policy, we will update the date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated policy.

8.7 Your Rights Under GDPR

9. Limitation of Liability

TGW and Marta Soto operate with the highest standards of professional care, training, and ethical practice. However, we wish to be transparent about the following:

  • Coaching and breathwork are personal development practices, not clinical treatments. Results are influenced by many factors, including the client's own level of engagement and readiness for change. TGW does not guarantee specific outcomes.

  • TGW is not liable for any decisions, actions, or changes made by the client as a result of their coaching or breathwork experience. You remain fully responsible for your choices and their consequences.

  • TGW is not liable for any physical or emotional reactions arising from breathwork sessions where the client has not disclosed a relevant health condition, or has chosen to continue against facilitator guidance.

To the fullest extent permitted by applicable law, TGW's liability for any claim arising from these Terms or from participation in our services shall not exceed the total amount paid by the client for the specific session or programme in question.

10. Professional Standards & Ethics

TGW operates in alignment with internationally recognised standards of coaching and breathwork practice, and with our own unwavering commitment to integrity.

We commit to:

  • Maintaining appropriate professional boundaries in all client relationships

  • Pursuing ongoing professional development and training

  • Referring clients to other professionals (therapists, medical practitioners, etc.) when their needs fall outside the scope of our work

  • Holding ourselves to the same standard of self-inquiry, honesty, and care that we ask of our clients

11. Governing Law & Legal Notice

These Terms & Conditions are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or from your engagement with TGW shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

Where EU consumer protection regulations apply, your statutory rights as a consumer are not affected by anything in these Terms.
